APPLICANT TERMS OF ENGAGEMENT AND ACKNOWLEDGMENT AGREEMENT
This Applicant Terms of Engagement and Acknowledgment Agreement (“Agreement”) is entered into by and between FMW Human Resources International Corporation (“the Company”, “FMW”, ) and the individual submitting an application for overseas employment placement through the Company (the “Applicant”, “you”, or “your”).
Before proceeding with your application, you are required to read, understand, and acknowledge each section below. By signing this document, you confirm that you have read, understood, and voluntarily agree to be bound by the terms of this Agreement.
1. Data Privacy Consent
As an applicant of the Company, you understand that FMW must collect, process, and retain your personal information and personal data, in both electronic and paper form, in order to process your application. This information will be handled in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173). Confidentiality will be respected, and appropriate security measures will be applied to prevent unauthorized disclosure.
By proceeding with your application, you agree and consent to the collection, processing, and use of your personal information for purposes related to your employment application, including overseas or local employment, training, support services, work references, other placements, public relations, and security or crime-prevention purposes.
In compliance with law-mandated requirements, you understand that the Company may share your basic credit and application data, including related updates or corrections, with the appropriate regulatory bodies and authorized entities.
Specifically, you voluntarily agree to and authorize the Company to:
- Continue to use your submitted information to process your documentation prior to deployment or hiring;
- Retain your information for a period of ten (10) years from the date of termination of your contract, after which your information will be deleted or destroyed;
- Retain and share your information with other statutory and regulatory bodies governing the Company in accordance with overseas workers regulations;
- Share your information with the Company's affiliates and necessary third parties for legitimate business purposes, under appropriate security safeguards.
You further acknowledge and warrant that you have obtained the consent of any other individuals whose information you may have provided in connection with your application, and you agree to hold the Company free and harmless from any and all complaint, suit, or claim arising from such disclosures.
2. Application Processing Period and Exclusivity Undertaking
You understand that the Company will observe an evaluation period of approximately three (3) weeks, counted from the date you sign your application, within which the selection committee of the prospective foreign employer will act on your application. You acknowledge that there is no guarantee that your application will be approved or that you will be selected for the position applied for.
In consideration of the Company's undertaking to process and endorse your application within this period, you agree not to apply through any other recruitment agency for the same or a similar position while your application with the Company remains pending during this three (3) week period.
Should three (3) weeks lapse from the date of signing without any update on the status of your application, this exclusivity undertaking is automatically deemed revoked, and you are free to apply with other recruitment agencies without restriction.
Note: Depending on the requirements of the job order and country of destination, you may separately be asked to execute a notarized Affidavit of Undertaking reflecting this same exclusivity commitment before a notary public. This Agreement does not replace that requirement where applicable.
3. Employment Verification Authorization
You hereby authorize FMW Human Resources International Corporation, or its duly authorized representative, to conduct employment verification on your behalf in accordance with the requirements of your country of application. This authorization covers verification of your employment history, credentials, and related information as may be required by the prospective employer, recruitment process, or relevant government agency.
4. No Video or Audio Recording Policy
While visiting or transacting at any Company office premises, including workstations, meeting rooms, reception areas, common areas, records areas, or any other area where personal data or confidential information may be accessed, viewed, or discussed, you agree that the taking of videos, audio recordings, photographs, live streams, or similar recordings is strictly prohibited unless prior written authorization has been obtained from Company Management.
You understand that any authorized recording must be limited to the purpose approved by Management, must comply with the Data Privacy Act of 2012, its Implementing Rules and Regulations, and issuances of the National Privacy Commission, and must first obtain the consent of individuals concerned where required. Any authorized recording must also observe the principles of transparency, legitimate purpose, and proportionality, and must not be excessive, unnecessary, misleading, or used beyond its authorized purpose.
You agree not to record, capture, copy, share, upload, post, transmit, circulate, or disclose any video, audio, image, document, conversation, or other information obtained within Company premises without proper authorization from Management.
5. Consequences of Violation
You understand that any violation of this Agreement , including the Data Privacy Consent, the Exclusivity Undertaking, the Employment Verification Authorization, or the No Video/Audio Recording Policy , may result in the suspension or termination of your application, without prejudice to any civil, criminal, administrative, or other legal remedies available to the Company or to any affected individual under applicable law.
6. Acknowledgment
By signing this document you confirm that:
- You have read and understood this Agreement in its entirety, or it has been explained to you in a language you understand;
- You are voluntarily giving your consent and undertaking, without having been forced, threatened, or paid to do so; and
- You agree to be bound by all the terms set out above for the duration of your application and, where applicable, your subsequent engagement or deployment through the Company.
